I disagree with this verdict (and many others WIPO has made recently). There are those of us (I'm one) who are FAIR domain name traders and investors that are being hurt by these unfair rulings. It is similar to real estate.. If you have the foresight to invest in oceanfront property well before its development time, why shouldn't you be compensated accordingly when someone else wakes up and realizes its worth?

WIPO has made unfair rulings for generic, untrademarked names. WIPO has also made unfair rulings on trademarked names, such as the one cited earlier. There are 73 Madonna trademarks (1 of which is Madonna Ciccone's - for clothing). And that's just USA trademarks, not international. And, _base_d on WIPO's decision, and since her trademark is for clothing, that site should only be used for the sales of clothing (if you believe it should've been awarded to her due to her trademark). Wanna bet it won't be?

_link_ to story (news ltd.) about Madonna's recent win over pornographic promoter Dan Parisi to win her domain name. The WIPO found Parisi lacks rights or legitimate interests in the domain name and that the name has been registered and used in bad faith. May not help - but good for a giggle.... I don't understand HOW she got that and why the Catholic Church isn't equally en_title_d to rights over the name Madonna. Or any other woman named Madonna. What's this _link_ you mention? beth

<snip I don't think Sting believes WIPO is fair either, since they denied his request for sting.com earlier this year. Or Stanford University when WIPO denied its claim to StanfordUniversity.com - and letting a doctor keep it for future development. Or the owner of fundfinder.com - a canadian - who had to give up his name and business because of a U.S.-only trademark. All I'm saying, Jeff, is that WIPO's decisions are not consistent or fair, and in time will affect all of us.

You would not hold the same opinion for a domain name such as ArtistJeff.com would you? Just because you have the name Jeff does not mean that YOU get to have any Dot Com that happens to have the name Jeff in it. If I had trademarked ArtistJeff , I would hold the same position that it is my property regardless of whether or not I had registered it. I agree wholeheartedly with your second paragraph. But you seem to be misreading my position. I think you agree with me.
